Applies to Snake Pot, PAC ARENA, Kart Arena and Blackjack, and to the websites snakepot.com and pac-arena.com (together, the Platform).

Please read section 11, 20, 24 and 25 carefully. They explain that transactions on the Solana blockchain cannot be reversed, that the value of SOL can fall as well as rise, and that our liability to you is limited. Nothing in these Terms removes any right you have under the mandatory consumer law of the country you live in.

1. Who we are and what this covers

The Platform is operated by an individual sole operator (the Operator, and in these Terms we, us and our). We are not a registered company. We do not hold a gambling licence in any jurisdiction — see section 12.

These Terms of Service (the Terms) form a binding agreement between you and the Operator governing your access to and use of the Platform, including all games, wallets, betting features, leaderboards, chat and voice services, and any related pages or APIs. Our Privacy Policy is incorporated into and forms part of these Terms.

If you do not agree to these Terms, do not deposit funds and do not use the Platform.

3. Acceptance and changes

By creating an Account, depositing SOL, entering any lobby (free or paid), or otherwise using the Platform, you confirm that you have read, understood and agree to be bound by these Terms.

We may amend these Terms from time to time — for example to reflect new games or features, changes in the law, or changes to our fees. The Last updated date and version number at the top of this page will always show when the current version took effect. Where a change materially reduces your rights or increases your obligations, we will give reasonable prior notice through the Platform or our Discord. Continued use after a change takes effect constitutes acceptance. If you do not accept a change, stop using the Platform and withdraw your funds.

4. Eligibility

By using the Platform you represent and warrant, each time you use it, that:

It is your responsibility, not ours, to know and obey the law where you are. Laws on paid competition and online wagering differ enormously between countries and, in some countries, between individual states or provinces. We do not give legal advice and we cannot tell you whether the Platform is lawful where you live. If you are in any doubt, take your own advice before depositing.

We reserve the right, at our sole discretion and without notice, to restrict or block access from any jurisdiction, to refuse or reverse an Account registration, and to require evidence of age or location. If we reasonably believe you are underage, we will suspend the Account and return any remaining deposited balance to the originating wallet; any winnings may be forfeited.

5. Your account

Accounts are created and authenticated through Privy, a third-party authentication and wallet-infrastructure provider, using either an email address or a Google sign-in. One person may hold one Account. Creating or using multiple Accounts to gain an advantage — including entering the same match twice, farming referrals, or evading a ban — is prohibited under section 13.

You are responsible for maintaining the security of the email address or Google account used to sign in, and for all activity that occurs under your Account. Anyone who can access your email or Google account can access your Account and the funds in your Wallet. Tell us immediately via our Discord or at morrisdonovan78@gmail.com if you suspect unauthorised access. We are not liable for losses arising from your failure to keep your sign-in credentials secure.

You may choose a display name. Display names are claimed on a first-come basis and are permanent once claimed by a wallet; a name already held by another player cannot be taken. We may remove or change any display name that is offensive, impersonates another person, or is used to deceive.

6. Your wallet and custody of funds

Each Account is provisioned with an embedded Solana wallet held by Privy. This is the single wallet used across every game on the Platform.

We never hold your private keys and we cannot move your funds. Key material is held by Privy under their own terms and security model. We are not a bank, a custodian, an exchange, or a money services business. Balances shown on the Platform are simply a reading of the public Solana blockchain — they are not a deposit with us and they are not insured or guaranteed by anyone.

Browser-extension wallets (such as Phantom, Solflare, MetaMask or Trust) are deliberately excluded from gameplay, signing, balances and deposit addresses. Only the embedded Wallet is used. SOL sent to any address other than your embedded Wallet address will not reach your Account.

In some circumstances Privy may require you to complete a recovery step before your Wallet can be used in a particular browser or on a new device. This is a Privy security measure, not a fault, and your funds remain safe while it is outstanding.

7. Deposits

You fund your Account by sending SOL on the Solana network to your Wallet address, shown on the Wallet page. Only SOL on the Solana mainnet is supported.

Sending any other asset, or sending on any other network, will result in permanent loss. We cannot recover tokens sent to the wrong address, on the wrong chain, or of the wrong type. Always check the address before sending.

Solana requires every account to retain a small rent-exempt minimum (currently 0.00089 SOL) and charges a network fee on every transaction. This means your Wallet must hold slightly more than the Entry amount for a paid Entry to succeed. We do not receive the network fee or the rent minimum.

8. Entries, pots and prizes

Free lobbies cost nothing and pay nothing. Paid lobbies require an Entry, which is transferred on-chain to the Escrow address at the moment you join, race, ante or ready up, as applicable to the game.

8.1 How an Entry is taken

An Entry is only ever taken in response to a deliberate action by you — pressing JOIN, READY or ANTE. The Platform will never take an Entry automatically or without a press. Before any Entry is taken we check that the server can accept you and that your Wallet can produce a valid signature; if either check fails, the Entry is refused and you are not charged.

8.2 Settlement

Outcomes are determined by the game servers, which are authoritative. Prizes are paid from Escrow to the winning Wallet or Wallets according to the rules of the game concerned, which are described on each game’s page — for example, winner-takes-pot in Kart Arena, closest-to-21 in Blackjack, and carried-balance cash-outs in Snake Pot and PAC ARENA. Payouts are calculated in lamports and are not re-converted through any price feed at the point of payment.

8.3 Errors

If a match, prize or balance is affected by an obvious error — including a software bug, a server fault, a duplicated payout, or a manifest pricing or display mistake — we reserve the right to void the affected match and to correct balances, including recovering amounts paid in error. We will not use this right to reverse a legitimate result you simply won.

9. Platform fee

We charge a Platform Fee of 10% on settled winnings and pots. The fee is deducted at settlement and the remainder is paid to the winner or winners. Free lobbies carry no fee. Where a particular game or promotion uses a different rate, that rate is stated on the game’s own page and takes precedence over this section for that game.

The Platform Fee is separate from Solana network fees, which are charged by the network — not by us — and are payable on every on-chain transaction including deposits, Entries and withdrawals.

We may change the Platform Fee. Any change will be published on this page with a new version number and will apply only to matches entered after it takes effect.

10. Cash-outs and withdrawals

Cash-out means claiming your carried balance in a live game. In Snake Pot and PAC ARENA a cash-out is server-authoritative and takes a fixed period to complete, during which you remain vulnerable and cannot cancel. This is a deliberate rule of the game, and it is not a fault.

Withdrawal means moving SOL out of your Wallet to any Solana address you choose, from the Wallet page. Withdrawals are on-chain transfers signed by your own Wallet. We do not impose withdrawal limits, holding periods or minimums beyond what the Solana network itself requires, and we do not charge a withdrawal fee.

We may delay or refuse a payout or withdrawal where we reasonably suspect fraud, cheating, collusion, multi-accounting, exploitation of a bug, or a breach of these Terms, and for as long as is reasonably necessary to investigate. If we refuse a payout we will tell you why.

If a payment cannot be made in full — for example because the Escrow balance is insufficient due to a fault — we will refuse the payment and investigate rather than pay a reduced amount. A refused payout does not extinguish your claim.

11. Blockchain transactions are final

Transactions on the Solana blockchain are irreversible. Once an Entry, prize or withdrawal is confirmed on-chain, neither we nor anyone else can recall, cancel or reverse it. There is no chargeback, no dispute mechanism and no refund route at the network level.

You accept that you use the Platform with this understanding. Where we do make a discretionary refund — for example where a fault of ours charged you for a match you could not play — we do so as a matter of goodwill and operational fairness, not because the transaction itself can be undone, and doing so once does not oblige us to do so again.

12. Skill-based competition; no licence

The Platform offers competitive games in which the outcome is determined predominantly by player skill — reaction, control, positioning, risk judgement and decision-making — rather than by chance. Entries are entry fees for competitions, and pots are prizes. We operate on that basis.

This is a legal position, not a guarantee. Whether a given game is treated as skill-based competition or as regulated gambling is decided by the law of your own jurisdiction, and different jurisdictions reach different conclusions about the same game. We hold no gambling, betting or gaming licence in any jurisdiction, and we make no claim to be regulated or supervised by any gaming authority. You are responsible for satisfying yourself that your participation is lawful where you are — see section 4.

13. Fair play and prohibited conduct

You must not, and must not attempt to:

Anti-cheat and abuse detection are partly automated. Where an automated system contributes to a suspension, you may ask for human review by contacting us — see section 27.

If you discover a bug that affects money or fairness, please report it to us privately via Discord or morrisdonovan78@gmail.com rather than using it. We will not penalise good-faith reporting.

14. Disconnections and interrupted matches

We do not refund Entries for disconnections in any game. If you lose connection, close the tab, run out of battery, or leave a match in progress, your Entry stands and your position is resolved by the rules of the game.

This rule exists because a refund-on-disconnect policy is trivially abusable: a player losing a match could simply disconnect to recover their Entry, at the direct expense of the players who were beating them fairly. The rule applies equally to everyone, including us.

Where a match is interrupted by a fault on our side — a server crash, a failed deployment, or a platform outage that prevents a match completing — we will use reasonable efforts to identify affected players and restore or refund Entries. This is at our discretion and depends on what the records show.

15. Player-versus-player betting

Where offered, betting features on the Platform operate as a player-versus-player exchange: your stake is matched against another player’s opposing stake. We are not a counterparty to your bet and we do not take a position against you.

We may operate referral programmes, scheduled events, prize pools and promotional credits. Each is subject to its own published rules, which form part of these Terms for anyone taking part, and to the following:

17. Chat, voice and user conduct

The Platform includes in-game text chat and, in some games, voice chat. Content you send is transmitted to other players in the same lobby. You must not send content that is unlawful, abusive, hateful, harassing, sexually explicit, threatening, or that discloses another person’s private information.

We do not routinely monitor chat, but we may review it in response to a report or an investigation, and we may remove content and restrict chat or voice privileges. You retain ownership of what you send, and grant us a limited licence to transmit, store and display it as necessary to operate the service and enforce these Terms.

18. Suspension, bans and forfeiture

We may suspend or permanently ban an Account, restrict features, void affected matches and withhold or reclaim winnings where we reasonably determine that you have breached these Terms — in particular section 4 (eligibility) or section 13 (fair play).

Forfeiture is proportionate: we will normally forfeit only amounts traceable to the breach. Funds you deposited and did not win through prohibited conduct will be returned to your originating wallet where we are lawfully able to do so, unless we are required to withhold them or we reasonably suspect they are the proceeds of crime.

19. Responsible play and self-exclusion

These games involve real money and real losses. Most players lose more often than they win. Please treat what you spend as the cost of entertainment, not as an investment or a source of income.

Some practical guidance:

Self-exclusion. You may ask us at any time to close your Account permanently, or to suspend it for a stated period, by contacting morrisdonovan78@gmail.com or our Discord. We will act on the request as soon as reasonably practicable, help you withdraw any remaining balance, and will not require a reason. We will not knowingly re-open an Account excluded on responsible-play grounds before the stated period has ended.

Elsewhere, Gamblers Anonymous maintains international contacts at gamblersanonymous.org. We are not affiliated with these organisations and receive nothing for listing them.

You acknowledge and accept each of the following risks:

21. Availability, maintenance and changes

We provide the Platform on an ongoing best-efforts basis but do not guarantee uninterrupted or error-free availability. We may modify, suspend, or discontinue any game, feature or the Platform as a whole, and may perform maintenance or deploy changes at any time, including during play.

If we discontinue the Platform permanently, we will give reasonable notice where circumstances allow and will take reasonable steps to enable players to withdraw remaining balances. Because your Wallet is held by Privy rather than by us, your funds remain accessible to you through Privy independently of the Platform.

22. Intellectual property

The Platform, its games, source code, artwork, sprites, sound, branding and the names Snake Pot, PAC ARENA and Kart Arena are owned by the Operator or licensed to us, and are protected by intellectual property law. You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to access and play the games for personal, non-commercial entertainment.

You may not copy, distribute, host, resell, frame, scrape, or create derivative works from the Platform, or use our branding in a way that suggests endorsement or affiliation, without our prior written permission. All rights not expressly granted are reserved.

23. Third-party services

The Platform depends on third parties, each of which operates under its own terms and privacy policy: Privy (authentication and wallet custody), the Solana network and its RPC providers, Vercel (hosting), Upstash (data storage), Ably (realtime messaging), Discord (community and support), and third-party price feeds.

We are not responsible for the acts, omissions, outages, security or policies of these providers. Their failure may interrupt the Platform or prevent a transaction from completing. Your Wallet, in particular, is governed by Privy’s terms as well as ours.

24. Disclaimers

To the fullest extent permitted by law, the Platform is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation.

We do not warrant that the Platform will meet your requirements, that defects will be corrected, or that any particular outcome, payout or return will be achieved. Nothing on the Platform constitutes financial, investment, tax or legal advice.

25. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded or limited.

Subject to that, and to the fullest extent permitted by law:

If you live in a jurisdiction that does not allow some of these exclusions, they apply to you only to the extent permitted there, and your mandatory statutory rights are unaffected.

26. Indemnity

You agree to indemnify and hold the Operator harmless against any claim, demand, loss, liability or reasonable cost (including legal fees) arising out of your breach of these Terms, your misuse of the Platform, your infringement of anyone’s rights, or your breach of any law — including any law applicable to you regarding paid competition or wagering.

27. Complaints and disputes

We would rather resolve a problem than argue about it. If something has gone wrong — a missing payout, an Entry taken for a match you could not play, a suspension you believe is unjust — please contact us first at morrisdonovan78@gmail.com or through our Discord.

Please include your wallet address, the approximate time, the game and stake involved, and any transaction signature you have. Nearly every money question can be answered definitively from the public blockchain record, and we will look. We aim to acknowledge complaints within 5 business days and to resolve them within 30 days.

If we cannot resolve the matter between us, either of us may pursue the dispute in the courts identified in section 28. You may also have the right to bring a claim in the courts of your own country of residence if the mandatory law there provides for it.

28. Governing law

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes), are governed by the law of the country in which the Operator is resident, and the courts of that country have non-exclusive jurisdiction.

If you are a consumer, this does not deprive you of the protection of any mandatory provision of consumer law of the country where you habitually reside, and you may be entitled to bring proceedings there.
